I can't reproduce this on my 4S running iOS 6.
When I press home twice on the lock screen the playback controls appears every
time regardless if I'm listening to music or a podcast and they also appear if
nothing is playing.

playing. I tried pressing home again twice and this time the controls came
up just fine. So, maybe you can try this. Start playing
