AFAIK (without doing a lot of research) there is nothing in the ISM regulations
that specifies channel size. The rules cover frequency, use, out of band
emissions, etc. but so not specify channel size, modulation, etc.

The UBNT radios are certified to use whatever CW they have been programmed
to use which has met certification requirements. Only the FCC can tell you
to stop using any frequency.
We once had Verizon going into public 900Mhz band from licensed band and we
got them to fix it.
