From my understanding the FCC only has provisions for towers 200 ft or taller, that they register. And guildlines for masts, not to exceed 10 feet under Otard. Everything in between is up for debate and controled by local zoning rules. Not all local governementshave a classification forprivate backyard towers, as they typically weren't something commonly built to talk about when rules were made, based on estimated costs. Often its bundled into telecommunications towers like cell phones carriers use, and it could be argured that its not a telecommunications tower, but a broadband tower.But there usually is also rules on a tower structure. Technically, with enough justification and engineeringthere isn't any limitation on where a tower is built under thespecial exceptions process. Its jsut really difficult and expensive to get approval to build something beyond the pre-approved rules. The idea is to conform to any rules that exist that prevent you from having to go through special exceptions so you are not delayed and don't incur the cost of doing so. The second a special exceptions is considered, delays and costs can skyrocket depending on the locality. Our Montgomery County Special exceptions rule require 150 feet from neighbor's property for every 100 ft of tower. The reasons are obvious, for the safety of your neighbors if it were to fall. The FCC told me that if I had a problem working with local governement, I could ask for their assistance, and they could help encourage the locality, because the local governement is required to facilitate a means for locals to pursue their options for tower building. However, ultimately it was the locality's right to rule. My question to you is, why do you ask? The entity you need to ask is the local governement that has authority. If the local governement doesn't haveregulations on the towers, take advantage of that and start building before they do, and likely you'll be grandfathered in by then. Or are you having problems working with the local governement? IF having problems, the best bet is to lookat FCC regulations, that require local governements to offer support in a timely manner. There were some cases a while back on that, where the governement was sued,because they cost the private industry millions of dollars because of the delay of authorizing permits, that should have been authorized. In the end, I think the Municipality won, because it was ruled that they didn't want to make municipalities to be responsibile because then they would be afraid to make jusdgements when they were undertrained on how to make the judgement, and they feared it would force authroizing towers that shouldn't be, to reduce liability, and therefore not in the publics best interest. Or something to that nature. But rules were proposed to be put inplace that would require municipalities to not unnecessarilly delay the authorization process. Its a grey area of much debate. Scriv, I used to conduct advanced FAA studies when I worked for a large tower company. You can use the TOWAIR system on the FCC WTB website to get a rough idea of the requirements near an airport but to get maximum heights there are many factors mainly dealing with invisible surfaces that relate to instrument approach procedures. They can get very complicated. Towair can also give you false positive indications that you would need to light a tower. This is mainly due to the fact that TOWAIR calculates the distance to the airport reference point rather than the closest point to the actual ends of the runway. While this is no big deal in most cases, it can be if you are located close to the field. As a tower company we used to figure out the best possible locations and heights using some great software from www.airspaceusa.com. While the software is expensive for the casual user, the owner Clyde Pitman can run studies for you. He is a retired FAA air traffic controller and very knowledgeable on the subject. If anyone needs to locate a tower near an airport feel free to get in touch with me and I'll let you know all the tricks to get the maximum heights. Simple things like level of survey certification can gain you up to 50 feet in additional height allowed by the FAA. That's what I had been told. And even if there is an airport, I had heard that if your tower is not along the line the airplanes use to land/take off, you're ok. there are two local airports within 10 miles of my tower and the town didn't say anything, and the faa friend of the engineer we work with said we'd be ok. I had someone tell me today that a couple years ago they made a law that if you had a 100' tower it needed to be 150' away from the road. And they said that older towers would be grandfathered in.
