Arrrgh, this is infuriating! What that HR rep told you is absolutely 100%
unadulterated illegal!!! It doesn't matter whether it was off the record or
on a bill board - that is blatant age discrimination, and I hope you won't
stand for it! Not only is the employer flat out illegally discriminating
against you based on your age (and by the way, you are in a protected class
- see below), but that HR Rep should be fired for participating in this
criminal activity, too. Employers market or not - this is so wrong! I hope
you realize the importance of taking this to task, and immediately contact
the Equal Employment Opportunity Commission (EEOC) in your region. There
are criminal penalties associated with this despicable behavior!

The Age Discrimination in Employment Act of 1967
(http://www.eeoc.gov/laws/adea.html)
The following is taken the text of the Age Discrimination in Employment Act
of 1967 (Pub. L. 90-202) (ADEA), as amended, as it appears in volume 29 of
the United States Code, beginning at section 621. The ADEA prohibits
employment discrimination against persons 40 years of age or older. The
Older Workers Benefit Protection Act (Pub. L. 101-433) amends several
sections of the ADEA. In addition, section 115 of the Civil Rights Act of
1991 (P.L. 102-166) amends section 7(e) of the ADEA (29 U. S.C. 626(e)).

It shall be unlawful for an employer: To fail or refuse to hire or to
discharge any individual or otherwise discriminate against any individual
with respect to his compensation, terms, conditions, or privileges of
employment, because of such individual's age.

Good luck, William. I hope you do not stand for this!

What is irritating is when you get the call from HR, and the HR rep
considers him/herself to be an expert negotiator, and refuses to give you
any indication of salary range at all, but instead demands your salary
history. Having worked as a consultant for several years, I've made
anywhere from 48K to 110K per year, depending on client and project. If you
tell the HR rep 48K (extreme low end, taken when times were tight), they
presume you will accept 46K for the incredible opportunity of working for
their magnificient company. If you tell them 100K, they say "Thank you" and
you fall into the Black Hole.

I recently had an HR rep tell me, off off off off off off OFF the record,
that I lost a position due to my age, which is 45. Companies, she
explained, no longer seem to want long term employees who want a stable
environment they can retire from. Companies want young, super-charged,
degreed certified test-passers who are also self-styled genuises that come
in, put in 3-5 years, and move on so the parent company does not have to pay
retirement benefits.

Face it guys....it's an EmployERS market right now, and they damn sure know
it.
