RESOLUTION OF THE  UN  COMMISSION FOR INDIA AND PAKISTAN    (UNCIP) OF AUGUST 
13, 1948
PART II
 
TRUCE AGREEMENT
 
A 2. The Government of Pakistan will use its best endeavor to secure the 
withdrawal from the State of Jammu and Kashmir of tribesmen and Pakistani 
nationals not normally resident therein who have entered the State of the 
purpose of fighting.
 
3. Pending a final solution, the territory evacuated by the Pakistani troops 
will be administered by the local authorities under the surveillance of the 
Commission.
 
(Instead the Pathan Tribesmen and Pakistani Nationals are now the most powerful 
land owners and Military as well as Civil bureaucratic rulers. There were no 
Pakistani troops there till 1973.)
 
 

7. THE INDIA-PAKISTAN QUESTION
 
various annual reports of the UN Security Council contain a summary account of 
the proceedings of the Council on this question:
 
A. COMMUNICATIONS FROM THE GOVERNMENTS OF INDIA AND PAKISTAN
 
68. On 5 August 1957, Pakistan notified the Council (S/3860) that, from 
information available to it, it appeared that India had settled in Jammu and 
Kashmir a large number of non-Muslims, who were not residents of the State. By 
this act, India was contravening the Security Council resolution of 17 January 
1948 (S/651) which had asked the parties to refrain from doing or permitting 
any acts which might aggravate the situation. This move was being made in order 
that India might assert later that a plebiscite had become progressively more 
difficult because of changed circumstances.
 
69. On 9 August 1957, India informed the Council (S/3861) that the allegations 
contained in the letter of Pakistan (S/3860) were false and baseless. No 
non-resident of Jammu and Kashmir was permitted to become a resident and no 
evacuee property could be allotted to any non-resident. The refugees had fled 
from Pakistan occupied areas of Jammu and Kashmir. India had not acted in 
contravention of the Security Council resolution of 17 January 1948 (S/651). 
The relevant facts were that Pakistan was in occupation of part of the 
territory of the Union of India by aggression and in violation of the Security 
Council resolution of 17 January 1948 and the two resolutions of the United 
Nations Commission for India and Pakistan.
 
(It is very painful to observe that the Govt of Pakistan flagrantly violated 
this principle of State Subject Rule in Bolor i.e. Northern Areas of the State 
of J&K from the very beginning and is changing the demography of the area. The 
State Subject Rule is held in abeyance in one third of the area linked with 
Kashmir dispute and colonized by the Govt of Pakistan. It was done away with 
the evil intent of bringing in and settling non local Pathans, Hazarawals, 
Punjabis etc in the area)
 
 
LOCAL AUTHORITIES

165. As regards India's demand that the administration and control of the 
northern areas should revert to the Government of the State of Jammu and 
Kashmir, the Pakistan representative pointed out that under part II A (3) of 
the 13 August 1948 resolution the northern areas should continue to be 
administered by the "local authorities" and that under part II B (2) of the 
same resolution the Indian and State armed forces must remain on their own side 
of the cease-fire line.
 
447. The representative of India next said. By-passing a fact, however, did not 
mean that it did not exist. Because UNCIP had taken account of facts, it had 
not questioned the sovereignty of the Jammu and Kashmir Government and had not 
given Pakistan a place either in plebiscite organization or in the Government 
of the occupied area, which was supposed to have been given to the local 
authorities.
 
·PARA 155. The following submissions were presented by the Pakistan Govt on 
part II of the resolution 1948: C2 - Page 29. Paragraph A, 3-It was necessary 
to define: "Local Authorities", which raised the question of the Azad Kashmir 
"Government" and Pakistan Political Agent in Gilgit. 
(This happened in Feb 1949. This is the most criminal act of the then Govt of 
Pakistan, triggering glaciers of lies, frauds, blunders and misrule. The extra 
assistant commissioner / tehsildar Sardar M. Alam Khan belonging to Kot 
Najeebullah of Haripur, Hazara tragically became the non local "Local 
Authority". He was called to help as a liaison officer with the interim Islamic 
Govt of Gilgit-Baltistan; the actual Local Authority. He was never a 
replacement of Dogra Governor Ghansar Singh. He connived with the toppled Dogra 
regime servant Maj William Alexander Brown, Sitara-e-Pakistan and laid the evil 
foundation stones of a devilish rule. There are innumerable official proofs of 
the existence of the interim Govt of Gilgit-Baltistan. With the start of the 
year 1949, Govt of Pakistan had finalized a deceit and a satanic plan. It 
followed the demise of Mr. Mohammad Ali Jinnah. On 4 March 1948, the position 
of Hunza and Nagar was finally clarified by English
 Maj Gen W.J.Cawthorn of the Govt of Pakistan and on 28 April 1949, Karachi 
Agreement was finalized and Muslim Conference started its activities in Gilgit. 
Ironically and stupidly the then Govt of Pakistan in appendix para 7 to Annex 
24 dated 3 May 1949, and signed by M.A. Gurmani writes to UNCIP by admitting, 
"An emergency administration was set up which took over effective control of 
the entire Gilgit Agency and Sub-Division, Gilgit Wazarat and Rondu Sub0Tehsil 
of
Baltistan. The local authorities announced the desire of the people to accede 
to Pakistan in a series of telegrams to the Pakistan Govt". He has wrongly 
mentioned the dates in his letter and has tried to confuse the situation by 
mentioning local authorities instead of one Local Authority. The actual Local 
Authority hoisted and waved its own flag, much similar to the flag of Azad 
territories of the State of J&K. Who and why the other flags were officially 
hoisted are to be found out for their real intentions.)
