Strictly speaking a lawyer might argue the language that since it is not on the list then it is legal. In the spirit of the law however if it was never tested then no one knows if it's legal or not. USGA doesn't go out and gather heads. The manufacturer's have to send them in and, I believe, pay for the testing. The USGA will send letters to the manufacturer telling them if they pass or not. The manufacturer should be willing and able to supply a copy of this letter to anyone, especially a dealer, who requests it so that they may have proof if anyone questions it, such as in this case.
