No, I didn't try the CVS version yet, but I made some research on the problem 
on the 1.38 version.
I tracked down the problem to "304 not modified" response, and changed the code 
so that instead "304" shttpd allways returns "200" with the file content.
It shurely result in a heavier traffic, but the problem's gone and the traffic 
is not an issue for me.

Unfortunately, I don't have enough time right now to dig deeper in the problem.
It is somewhere near the "304" response and as it seems it appears mostly/only 
on windows with IE.
