No, that is not true. Maddr is a via parameter (and a URI parameter).
When a client sends a multicast address, it adds an maddr parameter to
its via header. This is described in Section 18.1.1 of bis-09.
Typically, the R-URI would also contain a URI that has an maddr
parameter (which is how the proxy/uac knew to send the request multicast
in the first place), but thats not necessary if the proxy knew to do so
through some other means.

"cannot" is ill-defined. It SHOULD NOT, which means it ought to be 1
unless the proxy has a darn good reason to use a different value.
