If you have a tag in the to-header, then you assume the request in within a dialog
(how can the UA tell the difference between a request outside a dialog and the tag and
a request within a dialgo with unknown to tag?). If you don't find a dialog associated
with it, you either accept or reject it (based on your implementation).
