Actually, it is asking who will take the responsibility that the two invites 
have duplicated Call_ID + From Tag.

Can you please explain what a "re-INVITE without the To tag is"?
It makes no sense, a dialog mathing request MUST contain the SAME From tag, To 
tag and Call-ID of previous transactions in same dialog.
If a new request hasn't To tag then it's not an in-dialog request (so it's not 
a re-INVITE).
