As you quoted, "The caller's UA MAY send a BYE for either confirmed or early 
dialogs" and "The BYE request is used to terminate a specific session or 
attempted session".  The offer-answer status is irrelevant; UA1 can send BYE 
once the early or confirmed dialog is created.
