There is no single correct answer. A phone is shown as "busy" only if it reports that it has a phone call. There is no single standard for how a phone declares itself to be DND, but it appears that no phone does it by reporting that it has an active call. Although DND status should be reported as part of "presence" information, I don't know how much that is implemented, either. In practice, I don't think we can make any test cases for this.
