You need to be careful about libel. The courts take a dim view of
unsubstantiated claims that have a significant impact on someone's
career (and rightly so).
I think this is a clear case of theft, regardless of the technology
involved. More importantly I think this is a serious case of dodgy
ethics in the individual involved, and that should be communicated to
potential employers. But be careful
