I wouldn't suggest a port scan. It is illegal to port scan another server without permission.

...and it would be necessary to demonstrate that impairment actually occurred...
The offences are categorised as "serious" (ss 477.1, 2, 3) and "other" (ss 478.1-4). In all cases, some nasty intent is required. Again, I doubt that a port scan would qualify.
I'm not sure what other "computer" offences there are, so this is not definitive.
