I wouldn't suggest a port scan. It is illegal to port scan another server without permission.

access, modification or impairment." Only (c) seems remotely relevant to
a port scan.

...and it would be necessary to demonstrate that impairment actually occurred...



The offences are categorised as "serious" (ss 477.1, 2, 3) and "other" (ss 478.1-4). In all cases, some nasty intent is required. Again, I doubt that a port scan would qualify.

I'm not sure what other "computer" offences there are, so this is not
definitive.
