Have you tried -u with zfs receive?

Yes. I did a zfs send -Rp zones@backup_all | zfs receive -Fu backup/smartos

The zvols are showing up in the backup zpool with mount points and after some time the system really starts acting strange. I power cycled the box and the box boots up with mount points somewhat split between the zpools. It is quite strange.

The mountpoint attribute will still be there, but the filesystems shouldn't be mounted.

If the original filesystem is mounted, any subsequent attempts to overlay the mountpoint will fail.

If you are going to reboot the system, export one of the pools first so only one is there on reboot.
