done clean install from scratch and all other variations. 
reseated RAM, power manager reset, you name it...

This macbook doesn't always wake from sleep. I think it's 
basically duff. the hardware disk checks out ok. It's actually a 
work machine I managed to convince them to buy so I don't want 
to spend money on it but since I can't identify a reliable 
fault, it will be hard to get it repaired (it's got three years 
hardware warranty because it's Education purchase).

never mind!
