If this law does pass, and I actually get a ticket for using my phone while
driving, I will actually enjoy taking my appeal all the way to the
supreme court. It is too hard to define "ordinary driving public" in a
way that doesn't infringe on the rights of those of us that know better.

I will stop using my phone in my car as soon as they start issuing tickets
for people lighting up a cigarette and smoking while they drive.

I will stop using my phone in my car as soon as they make it illegal for a
driver to pull out his case of 100 CD's and change his music selection while
driving.

I will stop using my phone in my car as soon as they make it illegal for a
driver to pull out and unfold a map and look at it while they are driving.

I will stop using my phone in my car as soon as they make it illegal for a
parent to drive a car while attending to screaming young children and
infants.

I live in a small town, where often in my commute to work, at 9am, I see no
other cars on the road, not one. This law may be applicable for those who
chose to live in over-populated and congested areas, but should not apply to
those of us that would cause no harm to other
motorists.

I am intelligent, and do not engage in heated discussions or work
discussions or whatever while driving. If my phone rings, I answer, and
usually arrange the simple matter (such as where to meet someone) or arrange
a callback time and then hang up.

Assuming that all phone operators have the same mental incapacities of doing
two things at once is a false assumption. Research has shown that for the
drivers that cannot talk and drive at the same time, using the headset
instead of the handset does not improve their driving abilities. We should
focus on getting the bad drivers off of the road, not taking away rights
from a whole class of citizens.
