Yes, if you want to get your patch included into the mainline kernel, you should send a proper patch to the netdev ml with a cc to the socketcan ml. For that driver, it makes sense to include the Linux USB ml as well. The patch should be against David Miller's "net-next-2.6" tree. As this question is asked frequently, I' going to compose a little document "submitting-socketcan-patches" on that topic.
