AWEIL, 23 April 2013 [Gurtong] - Gabriel Gommah Wol disclosed to the
press that adultery, theft and divorce are the most pressing and
challenging cases that his court administration has been dealing and
asked for calm and love among the partners and couples during the
divorce case ruling at Aweil Local Court arena.

Gommah challenges the youth to control their temper when it comes to
handling homes affairs and love-related issues as he says that he
pities the kids who are innocently separated with their parents
neither have they been involved in the decision making of separation
nor having participated in the fault or route cause of the problem.

“Our daily hearing and ruling cases are always concerning adulteries,
thefts and requests for divorce from either of the partners or
couples. We have been trying our best to ensure that we give fines and
punishments the adulterers and thieves with what is applicable and
required by law in South Sudan Constitution and our customary laws of
Northern Bahr el Ghazal state. We always do our best efforts to
reconcile the couples who are baselessly demanding for divorce to
forgive each other and continue caring for their kids instead of
falling their children’s future,” he said.

According to South Sudan customary laws, Gommah adds that male
adulterers are forced by law to pay fines of 300 SPP and aruok
(compensation in term of cows; that’s equivalent to 7 cows to the
husband of a woman that originally paid dowries to the parents of the
woman).

He also says that the reconciliations process undertaken by his
judgment are meant to help reduce increase of street children as they
caring and tied responsibilities of both parents may be left to one
parent which at other time if not working or not educated may force
those children becoming street children simply because of lack of
caring and catering for the children’s basic needs.

“We hardly allow giving out divorce rulings when the plaintiff or
defendant is not listing the accurate reasons resulting to divorce
decision because we may be contributing to the negative factors that
contribute to harming our children indirectly. We must make sure that
the defendant has no legal ground or evidence to deny the allegations
imposed on him/her so that we are not later blamed for the outcome. As
to why we insist of separation of couples in some cases, we usually
tell the hardships children bear to grow and be responsible on their
own,” he said.

In personal point of view on marital cases, Nyirou Gau Gau says that
men of today’s generation lacks responsibility of caring for their
kids and family but instead turn to be drunkards and idlers leaving
the burdens on women who most case don’t have better education
background to be working for good job so that they afford caring for
their own children.

“Men are nothing nowadays, they cannot be trusted. They prefer
drinking alcohol and loitering around in the markets without knowing
what the children will eat. I personally had such problems but made up
my mind to be living alone and now better than before,” Gau said.
