So some spam gets through but it seems that mostly its because for some
reason the spam rules are not tested on that message.

Using:
Spamassassin version 2.63 with Mailscanner 3.15-3 on a RedHat 7.2 server
with kernel 2.4.20. Sendmail version 8.11.2.

1) that's a very old version of mailscanner. I'd strongly consider upgrading to something 32cent.

2) The "SpamAssassin ()" message indicates that MailScanner timed out on spamassassin. You'll want to check your SA runs for DNSBL timeouts, and also consider increasing your spamassassin timeout in MailScanner.conf.
