IANAL, but this kind of thing always baffles me.

the spammers *know* that when they send to unsolicited recipients it can be
illegal, depending on what state the recipient is located in.

the spammers *know* that when they send messages with forged or spoofed
header information, it can be illegal.

and yet, they persist in claiming that if the recipient does anything to
prevent them from sending spam, the *recipient* can be prosecuted.

it's simply not true. spam is not free speech, and it is not protected.

the reason spammers do this is to further dupe people into believing that it
is the spammer's right to take advantage of the recipient's personal
property, and to steal from network service providers.

to make matters worse, they keep dragging out this moldy old thing:

SB 1816 died in committee about 3 years ago. it is *not* proposed federal
legislation. it *was* proposed federal legislation - it was considered, but
never acted on. it was never passed. it is not a law, and sets no legal
guidelines over their actions. they use it as a screen to mask their illegal
activities, and most people don't even bother to check up on them.

furthermore, if people were to examine SB 1618 even more closely, they would
discover that sending to unsolicited recipients, with forged or spoofed
header information, and without including a *working* removal method (which
they always, always and never do) would actually have been *prohibited* by
SB 1618, section 301 paragraphs (a)(2)(A), paragraph (a)(2)(B), and
paragraph (b).

any legal language used by spammers serves *only* to frighten gullible spam
victims into refraining from sending that LART.

it has gotten to be a habit for me to automatically LART *any* message that
contains a reference to SB 1618.
