hi again.. sorry for the incomplete question... it was late...
so here we go..

#modem_run -f /usr/local/libdata/mgmt.o -m

modem_run.log:
Oct 27 16:24:28 Prostotnic1 modem_run[1040]: modem_run version 1.2-beta2

# pppoa3 -b -e 1 -v 1 -vpi 8 -vci 35 -c

pppoa3.log:
Oct 27 16:19:30 Prostotnic1 pppoa3[945]: pppoa3 version 1.2-beta2 started by
magny (uid 0)
Oct 27 16:19:30 Prostotnic1 pppoa3[945]: Control thread ready
Oct 27 16:19:30 Prostotnic1 pppoa3[945]: Modem found!
Oct 27 16:19:30 Prostotnic1 pppoa3[945]: pusb_set_configuration 1

and the process is terminated but the /var/run/pppoa3-modem1.pid are still
showing the killed process.
so when I try to start pppoa3 again it shows:
Oct 27 16:20:32 Prostotnic1 pppoa3[952]: A previous instance seems to be
running
Oct 27 16:20:32 Prostotnic1 pppoa3[952]: Sending the kill signal to 945 and
waiting...
but no process with pid 945 is running.

and when I manually kill the new process that only waits and remove the pid
file and restart pppoa3
I got a kernel panic...

ifconfig gives me:
tap0: flags=8802<BROADCAST,SIMPLEX,MULTICAST> mtu 1500
        ether 00:bd:5e:99:09:00

but without a active process attached

I reed in the ugen man file, that:

USB_SET_CONFIG:
This operation can only be performed when the control endpoint is
        the sole open endpoint.

This is only set for the -e 1 (speedtouch 330 modem) right?
what is the difference between speedtouch 330 and the usual USB modem that
makes it necessary to set that?

without the -e 1, I get in pppoa3.lib:

and ifconfig tap0:
tap0: flags=8802<BROADCAST,SIMPLEX,MULTICAST> mtu 1500
        ether 00:bd:19:38:01:00
        Opened by PID 588
