It is a BUILDING CODE issue that the engineer of record is to determine if the BUILDING and the systems therein require seismic protection. SInce NFPA 13 only tells you how and not when to install seismic protection, do you think the BUILDING OFFICIAL is expecting the contractor of one of the systems to determine whether protection is required? You might want to talk to them while you are filing a complaint on the PE that sealed the FP sheet (and maybe the engineer of record) with the state Board of Registration. We are fortunate in a few states (very few though) where the AHJ notifies the Board when the PE makes big, obvious mistakes.
