Well technically the AHJ can't require it without a city ordinance. But I'm directed to price to code. So if they have to be added later it would be a change order.

I believe 10.11.6.3 does allow the outdoor kitchen if it is permanent and in accordance with its listing. However, most I believe AHJ’s will require sprinkler protection. 10.11.6 Cooking Equipment. 10.11.6.1 For other than one- and two-family dwellings, no hibachi, grill, or other similar devices used for cooking, heating, or any other purpose shall be used or kindled on any balcony, under any overhanging portion, or within 10 ft (3 m) of any structure. 10.11.6.2 For other than one-and two-family dwellings, no hibachi, grill, or other similar devices used for cooking shall be stored on a balcony. 10.11.6.3* Listed equipment permanently installed in accordance with its listing, applicable codes, and manufacturer’s instructions shall be permitted. A.10.11.6.3 It is not the intent of this paragraph to allow the permanent installation of portable equipment unless it is permitted by its listing. I know in this area they are not. Friday, April 21, 2017, 10:56:22 AM, you wrote: Pete, as always, your input is appreciated. One of the things I liked best about working for your company (way back when) was having you as a quick resource. Thank you for taking the time to respond. I don’t know where to search for these Declaratory statements. I always do a fair amount of my own research before I send out for help. I don’t disagree with your latter statement but question whether a grill or cooktop would be classified as “cooking facilities”. For that matter, how is a permanent grill mounted in to a counter different from a portable grill that a resident on one of the lower floors might place on a balcony. I believe my answer to the client will be that I can find no requirement to provide fire sprinklers on the penthouse balconies. Here is a Declaratory statement for what you are asking minus the outdoor kitchens. If there is going to be a kitchen, I would say there will be cooking facilities and then in my opinion sprinklers would be required. Non-combustible construction. I refer to 8.15.7.1 which points me to 8.15.7.2. If I meet the requirements of 8.15.7.2, can I stop reading and omit the sprinklers on the balcony? Specifically, the penthouse level balconies have outdoor kitchens. It’s been questioned whether or not these are required to be protected. I can’t find anything in NFPA 101, the Florida Fire Prevention Code or the Florida Building Code that would be more restrictive than 8.15.7.2 I say the sprinkler protection is not required, outdoor kitchen or not.
