Are you sure you aren't getting the FLAC stream? I believe that statement is just a disclaimer just in case you do not have a HIFI subscription but were expecting FLAC. I use the Ipeng app and it reports I am streaming the FLAC version of Spoon's album Hot Thoughts even though I also see that same statement when I open the Tidal plugin. I also know that even for HIFI subscribers there are numerous albums where Tidal only has the MP3 to stream.
