I think it is likely that the reason they are saying this is they don't
want to assume liability of claining to provide healthy air.  If the City
were to license smoking parlors, or set specific levels of acceptable
smoke pollution, we could be opening ourselves up to the same kind of
liability.   This is why the tobacco industry warns us that there is no
safe level of exposure to tobacco smoke.
