But the strange thing is that the files are there and I can open them? Any ideas.

Are some of these files you are attempting to copy old aliases with broken links ?
Not sure if that would cause any problems.
There's also a chance there is a problem with the disk directory and it needs to be rebuilt.
You can start by rebooting/rebuilding the desktop and then running DiskFirstAid (if you can boot from another volume or a CD).
Ideally, you should own a copy of DiskWarrior....which for me has been the cure-all for all sorts of disk related problems.
