it’s a basic netgear 8 port gig switch, it doesn’t have an upgradeable
firmware and I know my desktop negotiates gigabit as soon as its powered on,
no lag. im thinking driver issue

Upgrade your switch firmware if possible and see if that makes a
difference. Does that same NIC behave the same using Windows? If so, well
it's just junk, if not, there's a FreeBSD driver issue of some sort.
