The lower maximum is intended to save power. if you know you are about to turn off the machine, you should do this as quickly as possible or you lose much more power than intended, leaving the max at 80% is not suited for this behavior. The user mode deamons only sets machine state based of current parameters, they cannot tell the future (yet). As far as I know, the cpufreq has nothing to do with overheat... as if it do if userspace is hang you lose your computer anyway...
