@Cody - Philip's examples both work with the PC version of Safari 4 public
beta. The menu is able to appear over the flash file which means the wmode
and z-indexing are working as they should.

Are you on the Mac or PC version of Safari?

Nope, both of those links do not work properly in Safari 4 beta.  I
will submit a ticket to apple.
