reading this part:

... its even more weired that they try to put legal pressure on the Swiss ISPs. Most 
probably, there is a lawyer making some money out of the case; under normal 
circumstances, someone who is offended by the site could easily file a simple lawsuit 
against a john doe at the place the site is 
hosted and then ask that the site should be shut down.

but of course, this bears the risk that the person filing the lawsuit can be target of 
a counter-claim...

i don't understand why the judge is going  here this rather unusual way when the 
person who is responsible for the site is already known...
