It's unfortunate that Google has managed to trademark the name
"shortwave" for an app for finding and playing podcasts. This will
undoubtedly create confusion in peoples' minds about what shortwave
really is. In trademark law, this is referred to as "dilution", but
in this case the term shortwave isn't already a trademark that can be
infringed upon and diluted.
I found this explanation by a trademark attorney about how a common
word can be trademarked. She says, "a common word can be trademarked
if it is arbitrary, suggestive, or in some cases, even descriptive of
the products. But it can't be trademarked if it is the product's
generic word." https://www.quora.com/How-can-a-common-word-be-trademarked
Several years ago after the creator of the Teenage Mutant Ninja
Turtles characters trademarked one of their names as 'Michelangelo',
most kids surveyed said that Michelangelo was a cartoon turtle with
superpowers. The dumbing down of America.
Someone should trademark a new enema product called Google. What's in a name?
