In the USA, the FCC apparently requires broadcasters and distributors
(including cable companies) to provide closed captioning - see
http://www.fcc.gov/cgb/consumerfacts/closedcaption.html .

The CRTC also requires this in Canada - see
http://www.crtc.gc.ca/Eng/INFO_SHT/b321.htm

Perhaps you can file a complaint with the CRTC and copy your cable
operator.  That might help them pay attention!
