Are we liable? The phone company is never thought to be liable if people do bad things using their lines. But, the phone company has lawyers that have helped settle this issue in their favor. I do not believe we have such resources.
Here's an example: Hackers can discuss hacking techniques on the telephone, but the telco is not liable. That is, I don't believe they are. Hackers can transmit viruses over telephone lines, but I don't believe that the phone company accepts liability. One issue that is not clear is when suspicious material is stored on Google Docs. I don't know what they (or the law) would do in such a case. Are there any federal guidelines that would take precedence over state legislation (in the US)? Interpreting every state's legislation would be can of worms/Medusa's head/Pandora's box. Is there anyone with knowledge of the legal aspects of the issue? It will just continue to come up in the future. And deep pockets have a way...
