http://wiki.openstreetmap.org/index.php/Privacy_Policy#GPS_Trace_Data is
perhaps a better link which answers the question asked and states policy.

The difference is that public GPX uploads can be downloaded in GPX form,
and are associated with your username. Non-'public' points can still be
downloaded, but timestamp and creator are stripped, leaving basically a
2d scatterplot with some extra information on some of the nodes sometimes.
