In sostanza non è valido estrarne un pezzo alla volta per ricostruirlo interamente, cioè non possiamo metterci d'accordo sulla ML affinché io estragga il primo dato e così via e alla fine abbiamo estratto tutto il database (oppure no? dopotutto siamo soggetti separati e i dati su OSM non sono di pubblico dominio ma di chi li ha inseriti) Ma d'altra parte, per valutare "sostanziale", il costitutore della banca dati non può spezzare la banca dati in frammenti atomici e sostenere che si è estratta una porzione sostanziale di un atomo: "A question may also arise as to what makes up the database. It may be that the owner of a geospatial database gathers data into one large database but then splits that into other products. Quindi non è automatico sostenere che, se estraggo dalla CTR Lombardia il confine amministrativo tra Corsico e Buccinasco, ho estratto una frazione significativa del layer "confini amministrativi" - questo layer stesso deve soddisfare i criteri della tutela sui generis.
