Not so much "disingenuous" as misleading. Tourism implies you can go there, yet clearly you cannot. Access=no if it's not reasonable to get there, or access=private if the owner doesn't want you to go there, should be a reason for leaving off tourism=.

Maybe the problem is the name of the tag? Tag names can be misleading. They aren't just metadata.
