Hi, I think Simon was talking about a slightly different issue than HOT's use of open data from the Mexican government as part of HOT's activities related to this disaster.
The Mexican government signed a separate letter allowing OSMF use of any data for OSM mapping and make it available under ODbL 1.0 they release related to this event. And signed it before the hurricane made landfall when this issues was first raised. I am glad to share that with interested parties.
