It's really one for the lawyers. 

1) I would look for another job if it required that I install key loggers on 
staff or student machines. In secret. There are so many problems with that one 
that I'll just summarize
    a) keylogging programs may not just send the output where you want it to go
    b) I suspect in many states their would be criminal sanctions
    c) You'd be included in the lawsuit.

2) If it is a staff/student machine and violations of the AUP are suspected 
then the machine can be collected and a lot of methods can be used to track 
their use of the machine.

3) if something criminal is suspected then you need to step back and hand it 
over to law enforcement. In fact with some types of material if you even have 
access to it an overambitious prosecutor may charge you as well as the offender 
(we all remember the case last year of the admin investigating sexting who was 
also charges because he saw the evidence)
