The contract was entered into. The bank gave them approval and faxed copies of the checks. I overnighted the money. They sold the car between the time they received the info from the bank and the time they got the actual paperwork and checks.

They should have ended the ebay auction like they said they were going to and it would have never happened. They didn't and they also didn't have the contract information in their system so that it would flag the car as under contract. To make matters worse, the owner told me the car was gone (off the lot) on Wednesday and the salesman told me it was still in their posession later that afternoon and that they were trying to find out if the ebay buyer was for real. They didn't send the money back immediately because of that and because they were trying to find a car to "make it right". I told them Thursday that I wanted the money back immediately along with the airfare that I lost and that I needed to see it by noon on Friday (typical next day USPS). They sent it FedEx and I didn't see it until almost 630 last night. I do have the money for the car, but had to get in their case again this morning about the airfare and I nailed them for the inspection fee that I paid too. The owner bought off on it, so I got all of my money back.

I did find another car in the STL area that came up yesterday. I picked it up today after we finally got all the money back where it belonged and another check cut. What a goat rope.

It sounds like they accepted his contract and money. If they sold the car before they sent the paperwork, that makes it even worse. No doubt he can get his money back but the dealer should have overnighted his money back. Any hesitation only makes it worse. Offering a different car makes it sound like bait and switch.

I think one of the parties has to take delivery or payment before the contract is valid. Either way, it isn't a good business practice for sure.

different car. They blamed it on ebay, but it's just a matter of not
having the HUEVOS to call the other bidder and tell him he can't have
the car and explain the situation. They don't want to hurt their
positive feedback rating on ebay.

They were supposed to have my checks back to me by noon today. So
far, it hasn't happened.

I won't mention company names on the list because that's not a good
thing, but I will gladly tell anyone who wants to know off list and
would be willing to add comments to their facebook page to do a little
blackballing. Needless to say, I'm just a little pi55ed - no, that's
an understatement. By the way, Ebay was absolutely no help in the
matter.
