This is a prproblem with how tiddlywiki parses strings. You need to use a set 
widget and a macro.

\define thisList() 
<$list filter="[tag[$:/Note]]$(TestVariable)$" />
\end

<$set name=TestVariable value={{!!test}} >
<<thisList>>
</$set>

should work.
