Then again, Apple has managed to patent and defend in court the ipad color scheme.

That would presumably be a design patent, which protects the ornamental design of a functional item (more like a trademark, really). Not at all the same as a utility patent (what most people think of as a "patent"), which protects the functionality of an item.
