Depends on how your institution's rules and state's laws are written.
In our case:
1.  Our procedure for resolving student/faculty conflicts requires as a
first step an informal meeting between student and faculty mediated by the
department chair.
2.  The Data Privacy Act does not cover criminal activity, on which this
case borders (implicit or explicit threats of violence).
