>From what I can tell, the TMDA-like patent has not actually been issued yet. Rather, it's still in the application process. i.e, it doesn't show up in the ``Issued Patents'' database at http://www.uspto.gov/patft/, but only under ``Patent Applications''. I believe this will make it much easier to invalidate.
