oops! Sorry for not properly reading the mail before responding. So Vani didn't mention that the cancellation and repolling were mere proposals just like the "None of the above" option in the EVMs. It is neither in the constitution nor is there anything like 1969 Act related to this. It is in The Conduct of Elections Rules, 1961. You can read about it here also: http://avee-ivee.blogspot.com/2006/11/2-49-o.html and the complete list of THE CONDUCT OF ELECTIONS RULES, 1961 here: http://lawmin.nic.in/ld/subord/cer1.htm 49-O. Elector deciding not to vote.-If an elector, after his electoral roll number has been duly entered in the register of voters in Form-17A and has put his signature or thumb impression thereon as required under sub-rule (1) of rule 49L, decided not to record his vote, a remark to this effect shall be made against the said entry in Form 17A by the presiding officer and the signature or thumb impression of the elector shall be obtained against such remark. 3vkrm
