Because the last mod did nothing, nada, niente (if your volume was at
100% before). 
The Touch is doing the exact same thing (applying the max volume to the
material either with the mod or because the volume was at 100% anyway).
Not even a timing difference can happen.

Anyone hearing a difference with this mod should 
a) go to the doctor to test his ears 
b) or test his index-finger if he really is not able to move the volume
slider to 100% 
c) or give me his drugs
