DHHS has attempted to clarify the FAXing issue via a FAQ at
http://aspe.os.dhhs.gov/admnsimp/q0055.htm:
     Question:  If a health care provider faxes a health care
     claim form, must the transaction comply with the standard?
     Answer of 12/28/2000:  Fax imaging and voice response
     transmissions are not subject to the HIPAA transactions
     standards but may have to meet privacy and security
     standards. Health plans may continue to offer these services,
     however, they must still be able to accept and send the
     HIPAA standard transactions.

I know this may not be exactly the answer you're seeking, but I suspect it's the best we're going to see for a while.  [This may change some day when a fax-like image is included [using HL7 encoding] within a binary segment of an X12 message -- as is being discussed for Claims (and other) Attachments.]
 
In other words, for now, I believe faxes -- to or from any source -- are not considered HIPAA transactions.

As I understand the regulations hardcopy paper Faxs are exempt from compliance with the format requirements in the Transaction regulations.  Does this also apply to Electronic Faxes?
