Not true...  Simply put; It is essentially impossible for a payer NOT to
be
subject to HIPAA because they are required to accept a standard
transaction
if a provider wants to submit one.  A provider however can make
themselves
not subject to any of the HIPAA provisions as long as they DO NOT

ANY OF THE "NAMED" (More could be added) TRANSACTIONS
