Where does the responsiblity of being compliant begin and end?
Would it be true to say that those within this community that create the
transactions have the bulk of the testing work and responsibility to
determine if they are HIPAA compliant or not? It would seem the receiver
cannot take on the responsiblity of ensuring that all senders are
compliant. I would suspect this is just another argument for
"certification". However, without a formal industry adoption or
govermental edict this becomes more of a challenge to all of us.

All of them! You cannot be compliant with HIPAA if your transactions do
not balance, or if you don't meet the inter-segment dependencies, or if
you don't care for the instructions in the gray boxes, or if your code
sets are non-HIPAA, or if you don't meet the situational requirements
that apply to your business. So, being compliant with syntax does not
make you compliant with the rest.
That is why we cannot think of the six levels as "levels" but rather as
types of testing that needs to be done. And you cannot say "I am
compliant up to level 5". You either are compliant with all of them or
you are not HIPAA compliant.
The exception could be if none of the "specialty" types of rules apply
to you. Obviously if you are an ambulance company you need to comply
with all the ambulance requirements, but if you are a pediatrician you
don't need to comply with the requirements for ambulance, or DME, or
oxygen, or home health, or hospice, or other "specialty" requirements.
In that case, none of the "Level 6" requirements would apply to you.
