The are "no-no's" in developing a trading partner agreement and unfortunately ... changing the "mandates" and/or "required" or any other part of the requirements in the IGs are not allowed. Section 162.915 of txns and code rule:A covered entity must not enter into a trading partner agreement that would do any of the following:
1. Change the definition, data condition, or use of a data element or segment in a standard.
2. Add any data elements or segments to the maximum defined data set.
3. Use any code or data elements that are either marked “not used” in the standard’s implementation specification or are not in the standard’s implementation specification(s).
4. Change the meaning or intent of the standard’s implementation specification(s).

Is there a section in the regs that allows covered entities to continue to utilize non-standard/non-compliant formats for some extended period of time so long as there is a mutual trading agreement? Assume the covered entities are trading partners that have been utilizing a proprietary format for quite some time.Thanks,Richard Robinson III
